Terms & conditions
These terms and conditions apply to applications for the 2012/2013 Vodacom Change the World programme (“CtW”);
CtW is delivered by the Vodacom Foundation, a division of Vodacom (Pty) Ltd (“Vodacom”), Vodacom Corporate Park, 082 Vodacom Boulevard, Vodavalley, Midrand, 1685.
By submitting an application, the applicant will be deemed to have understood these terms and conditions and to have agreed to be bound by them. All applicants shall accept and submit applications subject to these terms and conditions.

Application Process: |

1.1 |
All applicants must complete the online application form or download the application form and attach the required documentation. |
||||||
1.2 |

||||||
1.3 |
Previous NPOs and winners of the CtW Programme are not eligible to enter for this competition. |
||||||
1.4 |
Applicants may only select one NPO from the list of 10 (ten) pre-selected NPOs provided, where the applicant would like to work for 12 (twelve) months. |
||||||
1.5 |
Applicants shall also comply with any request to undergo statutory checks such as those performed by the Criminal Records Bureau. |
||||||
1.6 |
If any of the information requested for the application is incomplete or not provided, the incomplete application will not be evaluated and the applicant shall be unable to participate in the 2012/2013 Vodacom CtW programme. |
||||||
1.7 |
Once submitted, applications cannot be altered nor can the NPO or role be changed. |

2. |
Judging and Selection of Successful Applicants |
||||||
2.1 |
Every application will be individually judged according to its merit, the viability of implementation as determined by Vodacom or its agents and the skills the applicant brings to the project. |

2.2 |
The adjudication process is set out in the Frequently Asked Questions. |
||||||
2.3 |
The decisions of Vodacom, the panel of adjudicators and independent auditors in respect of all matters pertaining to the selection process are final and no correspondence will be entered into. |
||||||
2.4 |
The 10 (ten) successful applicants must keep the news of their success confidential until 30 March 2012 if they are either told of their success, or otherwise learn of it, before that date. |

3. |
Vodacom and NPO Support: |
||||||
3.1 |
Each successful applicant will become a full time employee of their selected NPO for the duration of the term and enter into a fixed term contract with their selected NPO for the period of 12 (twelve) months, subject to earlier termination for a fair reason and in terms of the Labour Relations Act (“LRA”), on a full time basis (“employment term”). |

3.2 |
Vodacom will donate a laptop, handset and airtime/data per month to each successful applicant. The successful applicant will be responsible for insuring the laptop and handset and all risk shall pass to the successful applicant upon delivery of the laptop and handset. |
||||||
3.3 |
The NPO will be required to enter into a “Vodacom Change the World” Grant Agreement with Vodacom which will include a requirement to stipulate some minimum terms in the contract of employment between the NPO and the successful applicant. |
||||||
3.4 |
Each successful applicant will receive a monthly stipend up to R25, 000 (twenty five thousand rand) from their NPO, provided by Vodacom. |
||||||
3.5 |
Vodacom has appointed an employment agency that will be responsible to deduct Income tax and statutory contributions from the successful applicant’s monthly allowance and pay to the relevant tax authority. The agency will provide proof of statutory taxes paid to the Vodacom on a monthly basis; |

3.6 |
The successful applicant shall be liable for any taxes payable in relation to any other income received by the successful applicant in the same tax year. |
||||||
3.7 |
Notwithstanding clauses 4.2 and 4.3 below, if a successful applicant is unable or unwilling to participate for the full 12 (twelve) month period of the employment term or if the successful applicant participates for only part of the Employment Term with a NPO, or if the successful applicant otherwise fails to comply with the terms of this agreement, Vodacom may withhold all or a pro rata portion, whichever is applicable, of the monthly allowance. Accordingly, the successful applicant shall not be entitled to payment. The employment contract with the NPO will contain provisions relating to withholding of payment in these circumstances. A court order may also be sought to enforce such provisions in terms of the employment contract. |

4. |
The Successful Applicant’s Responsibilities: |
||||||
4.1 |
Successful applicants must be able to start work with their selected NPO from Monday 2 April 2012 until end March 2013. |
||||||
4.2 |
Each successful applicant will from time to time, be required to attend and participate in internal and external publicity activities and media (including television, radio and print) interviews as required by Vodacom or the NPO, from the date that they are announced as a successful applicant through to the expiry of the Employment Term. Vodacom is not responsible for any additional expenses not agreed to which are incurred in attending any such interviews. |

4.3 |
If, for any reason whatsoever, Vodacom or its agents are not satisfied with a successful applicant's performance of their duties as set out in these terms and conditions or in terms of the employment contract with the NPO, the NPO may, after due process has been followed as envisaged in the Fixed Term Agreement “FTA”, terminate a successful applicant's employment. |

4.4 |
If, for any reason whatsoever, a successful applicant's employment with the NPO is terminated during the Employment Term whether by the successful applicant or the NPO, the successful applicant will receive a salary payment, benefit payments, where applicable, during the notice period but will have no entitlement to the balance of their salary for the remainder of the Employment Term or to any other benefits. The successful applicant will receive payment for any leave accrued but not taken, if applicable in terms of the employment contract. |

4.5 |
Each successful applicant is responsible for their own arrangements to notify their current employer (and/or educational institution, if relevant) and arranging the 12 (twelve) months leave (whether in the form of resignation from their usual employment or not) and neither Vodacom nor the selected NPO accepts any liability for any damage or loss arising there from except for any liability which cannot be excluded by law. |

4.6 |
The offer to work with the NPO for the Employment Term is not an offer of employment with any NPO or Vodacom. Once employment with the NPO has ended (whether before the expiry of the Employment Term or not) it is each successful applicant's responsibility, if they wish, to obtain further employment (whether with the NPO or elsewhere) and neither Vodacom nor the NPO accepts any responsibility for a successful applicant securing future employment of any nature. |

5. |
Publicity |
||||||
5.1 |
By entering this competition, applicants confirm that Vodacom and members of the Vodacom Group have the right to use each applicant's entry, updates and reports (including written, audio and visual forms) and any photos, videos or personal details and other publicity materials at its absolute discretion for promotional and reporting purposes and at no charge to Vodacom. By submitting an entry, each applicant unconditionally and irrevocably assigns all rights; title and interest in all copyright and all other intellectual property in any material provided to Vodacom and waives all moral rights in any material provided to Vodacom. |

5.2 |
Each finalist consents to the use of recordings of their voice and their image by Vodacom or members of Vodacom or the Vodacom Group (whether obtained from the successful applicant's entry, interviews, reports, updates or otherwise) for any promotional use related to the programme (including but not limited to their placement on Vodacom's website) without any further compensation to the finalist or successful applicant. Successful applicants acknowledge that Vodacom has the right but not the obligation to do so. |

6. |
General |
||||||
6.1 |
Vodacom's financial support is not transferable, exchangeable or redeemable for cash by the successful applicant or by the NPO. |
||||||
6.2 |
Except as expressly stated in these terms and conditions, Vodacom shall not be responsible for any expenses that applicants incur as part of the competition or, if successful, their placement with a NPO. |
||||||
6.3 |
No responsibility is accepted by Vodacom for late, lost or misdirected applications. |
||||||
6.4 |
No responsibility is accepted by Vodacom entries which have been declined for any reason whatsoever. |
||||||
6.5 |
Notwithstanding any other provision of these terms and conditions, neither Vodacom nor the NPO shall be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury that is suffered or sustained as a result of participating in this application process or as a result of a successful applicant's employment with a NPO, except for any liability that cannot be excluded by law. |

6.6 |
All applications become the property of Vodacom upon submission and will not be returned. |
||||||
6.7 |
Vodacom reserves the right to amend these terms and conditions from time to time. |
||||||
6.8 |
These terms and conditions shall be subject to South African law and governed by the exclusive jurisdiction of our courts. |

7. |
Privacy Notice: |
||||||
7.1 |
Vodacom will not rent, sell, share or otherwise disclose your contact details or personal information to third parties so that they can carry out marketing campaigns. However, it may be necessary to share your personal information with third parties who are involved in the delivery of the Change the World Programme (for example, CAFSA). These third parties may contact you on our behalf. Should we disclose your personal details to a third party, they will be obliged not to share or disclose your information withanyone else and not to use it for any purpose other than the purpose outlined by us. |

7.2 |
From time to time Vodacom may be obliged by law or order of the court to disclose your personal information to meet any legal or regulatory requirements or obligations. In such circumstances we will take all reasonable efforts to ensure that those requirements or obligations are in accordance with applicable law. |
